Welcome to Deliveny ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By creating an account or using Deliveny, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Deliveny is an AI-powered video creation platform that helps businesses create professional marketing and product videos. The Service includes video editing, AI-generated scripts, overlay systems, and rendering capabilities.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. User Content

Ownership: You retain all rights to the content you upload to the Service (videos, images, brand assets, text).

License: By uploading content, you grant us a limited license to process, store, and render your content solely for the purpose of providing the Service to you.

Responsibility: You are responsible for ensuring you have the necessary rights to any content you upload. Do not upload content that infringes on third-party intellectual property rights.

5. Acceptable Use

You agree not to upload or generate, and not to use the Service to distribute, any content that:

  • Infringes intellectual property — copyrighted video, audio, music, images, brand logos, or footage you don't own or have a license to use. This includes clips from films, TV shows, sports broadcasts, other creators' videos, and licensed music.
  • Is sexually explicit, pornographic, or depicts nudity outside of a clear educational / medical context.
  • Promotes hate, harassment, or violence against any individual or group based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristic.
  • Depicts or facilitates illegal activity, self-harm, animal cruelty, or harm to minors.
  • Impersonates a real person without their explicit consent — especially deepfakes or manipulated likenesses of public figures.
  • Is deceptive or fraudulent — misleading financial claims, fake testimonials, fabricated product endorsements.
  • Contains malware, spam, phishing links, or private information of third parties (personal data you don't have consent to share).
  • Attempts to gain unauthorised access to the Service, other users' accounts, or any system connected to it.
  • Scrapes, abuses rate limits, or resells the Service without our written permission.

We reserve the right to remove any content and suspend or terminate any account in violation of this policy, at our sole discretion, without notice. Repeat or egregious violations may be reported to applicable law-enforcement authorities.

6. Abuse & DMCA Takedown Reports

If you believe content on the Service violates the Acceptable Use policy above, or infringes your copyright, please email abuse@deliveny.com. We aim to review all reports within 48 hours.

For a DMCA takedown notice, your email must include:

  • Identification of the copyrighted work you claim has been infringed.
  • The URL or project identifier of the allegedly infringing content on Deliveny.
  • Your contact information (full name, email, physical address).
  • A statement that you have a good-faith belief the use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act on the owner's behalf.
  • Your physical or electronic signature.

We may share your takedown notice with the user who uploaded the disputed content. Submitting knowingly false notices may subject you to damages under Section 512(f) of the DMCA.

7. AI-Generated Content

The Service uses artificial intelligence to generate scripts, suggest overlays, and create video elements. AI-generated content is provided as-is. You are responsible for reviewing and approving all content before publishing. We do not guarantee the accuracy of AI-generated text or suggestions.

8. Third-Party Services

The Service integrates with third-party providers (HeyGen, ElevenLabs, OpenAI, etc.) for video generation and AI features. These services are subject to their own terms and conditions. We are not responsible for third-party service availability or performance.

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Deliveny and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Deliveny shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may close your account at any time by contacting us at hello@deliveny.com.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Finland. Any disputes shall be resolved in the courts of Helsinki, Finland.
